A1. Platform Agreement (applies to all Users)
1. Introduction and acceptance
1.1 This Platform Agreement (“Agreement”) is between Park EZ Pty Ltd (ACN 699 400 836) (“Park EZ”, “we”, “us”, “our”) and any user (“you”) of the Park EZ website (the “Platform” or the “Website”).
1.2 A User account may be created so you can act as a Guest (someone who has booked, or intends to book, a parking space) and/or a Host (the owner or authorised operator of a parking space listed on the Platform, “Parking Space”). Where you act as a Host, the Host Service Agreement (Part A2) also applies to you. Where you make or receive a booking, the Booking Agreement (Part A3) also applies to that booking.
1.3 By creating an account or using the platform, you agree to this Agreement, our Privacy Policy, our Cancellation Policy, and our Money-Back Guarantee Policy (each available on the Platform and incorporated into this Agreement), and, where applicable, the Host Service Agreement and Booking Agreement. If you do not agree, you must not use the Platform.
1.4 You must be at least 18 years old and capable of forming a legally binding contract under Australian law.
1.5 We may amend these terms from time to time. Any amendments will be provided to you. If you don’t wish to be bound by an amendment, you may terminate this Agreement; continuing to use the Platform after amendments take effect means you accept them.
1.6 We may assign or sub-contract our rights and obligations under this Agreement without your consent.
1.7 You agree these terms are fair and reasonable in the circumstances. If any provision is unlawful, void, or unenforceable, it will be severed to the extent required, without affecting the rest of this Agreement.
1.8 No delay by either party in enforcing a term of this Agreement is, or is deemed to be, a waiver of that term, and does not prejudice that party’s rights under this Agreement.
1.9 You grant us the right to communicate with you by any channel we choose, including email, phone, SMS, or push notification.
2. Nature of the service
2.1 The Platform is a marketplace that connects Hosts advertising parking spaces with Guests wishing to book them. Park EZ is not the owner, manager, or operator of any listed Parking Space, is not a bailee, garage operator, insurer, or real estate broker or agent, and (except as set out in the Booking Agreement, where we act as the Host’s agent to form the contract) is not a party to the parking arrangement itself. We have no control over the conduct of Hosts or Guests and, to the fullest extent permitted by law, disclaim liability for that conduct.
2.2 We facilitate listings, bookings, payment collection and remittance, dispute administration, and location-verification technology (see our Privacy Policy for how geotagged check-in/check-out data is handled).
2.3 Whilst we endeavour to ensure parking spaces listed on the Platform are of good quality, we offer no guarantee as to a parking space’s suitability for a guest’s requirements, and while we take reasonable steps to verify host-supplied listing information, we offer no warranty as to its accuracy.
3. Account registration
3.1 To register or make a booking, we will require adequate information from you, which may include full name, address, date of birth, mobile number, email address, and, for guests, vehicle registration, make, model, and colour. This information is handled in accordance with our Privacy Policy, which forms part of this Agreement.
3.2 You are responsible for keeping your login credentials confidential and for all activity on your account. If a third party becomes aware of your password and uses your account, they will be treated as your agent, and we will not be responsible for their actions; notify us immediately if this happens so we can suspend or close your account.
3.3 We are not responsible if you fail to provide valid contact information and consequently do not receive a booking confirmation or other communication.
3.4 We may suspend or close your account at any time if you breach this Agreement, the Host Service Agreement, or a Booking Agreement.
4. Listings
4.1 Hosts grant Park EZ a non-exclusive licence to display listing content (photos, descriptions, pricing, location) on the platform and in our marketing, and authorise us to refer to the host or their parking space to publicise Park EZ.
4.2 Listings must accurately describe the space, including any vehicle size restrictions, access instructions, availability windows, and access technology.
4.3 We may remove, suspend, or edit a listing at our discretion, including where it appears inaccurate, unlawful, or in breach of this Agreement.
4.4 A guest can only book a parking space once the host has agreed to the booking; the listing indicates availability, price, and location.
5. Location and geo-tag technology
5.1 The platform uses location technology, including mandatory geotagged photos taken by guests on arrival at and departure from a parking space, to verify bookings, resolve disputes, and support the Money-Back Guarantee and Cancellation Policy claims processes.
5.2 Full detail on what’s collected, why, who can see it, and your rights, is set out in our Privacy Policy, which forms part of this Agreement.
6. User conduct
6.1 You must not: use the platform unlawfully; misrepresent your identity, vehicle, or right to a parking space; interfere with or spoof geofencing, GPS, or other Platform technology; probe, scan, or test the vulnerability of the platform, or breach or attempt to breach its security or authentication; use the platform to send unsolicited messages or interfere with service to any user or network; forge header information in any communication sent using the platform; reverse-engineer, decompile, or disassemble any part of the platform; harass other users; or attempt to transact off-platform to avoid fees.
6.2 You must not contact a host or guest directly until a booking is confirmed, or until we direct you to do so.
6.3 We may investigate suspected breaches using account, booking, and geo-tag data as reasonably necessary and consistent with our Privacy Policy.
7. Suspension and termination
7.1 We may suspend or terminate your account for breach of this Agreement, suspected fraud, safety concerns, or repeated disputes, with notice where reasonably practicable. If you attempt to circumvent a suspension by creating a new account, we may terminate this Agreement and any account you hold.
7.2 If your account is terminated, any outstanding bookings with pre-payment may be refunded at our discretion, and the terms of this Agreement continue to apply to those bookings and their consequences (including fees, disclaimers, and liability).
8. Intellectual property
8.1 The platform, including its software, design, and trade marks, is owned by or licensed to Park EZ. You receive a limited, revocable, non-transferable licence to use it for its intended purpose only.
9. Regulatory and tax reporting (Sharing Economy Reporting Regime)
9.1 You acknowledge that Park EZ must comply with Australian law to operate the Platform. Under the Sharing Economy Reporting Regime (SERR) administered by the Australian Taxation Office (ATO), Park EZ is required to report certain transaction and personal data to the ATO — see our Privacy Policy, clause 12, for full detail on what’s reported.
9.2 By using the platform, you authorise us to provide this information to the ATO. If you do not agree, you must not use the platform. If you refuse to provide requested information within a reasonable time, we may suspend or terminate your account until it is provided.
9.3 You remain solely responsible for your own tax obligations, including income tax, GST, and any state or local parking/congestion levies. Guidance is available from the State Revenue Office of Victoria (sro.vic.gov.au/carspacerental) and Revenue NSW (revenue.nsw.gov.au/taxes/psl), or from your accountant.
10. Limitation of liability and disclaimers
10.1 Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, and nothing in this Agreement is intended to be, or should be read as, an unfair contract term within the meaning of that Law.
10.2 If you use the platform, you do so at your own risk. We have no obligation to conduct background checks on any host or guest, do not verify the statements of users, and do not review or visit parking spaces. Take reasonable precautions in all interactions with other users, particularly if you decide to meet in person.
10.3 The platform is provided “as is”, other than statutory warranties that cannot be excluded. We do not warrant that the platform will be uninterrupted, secure, or error-free, or that it will meet your requirements, and no oral or written advice from Park EZ creates a warranty not expressly made in this Agreement.
10.4 To the extent permitted by law, and subject to clause 10.1, Park EZ is not liable for: lost profits, loss of data, or the cost of procuring substitute goods or services; consequential, special, indirect, or exemplary damages arising from errors, mistakes, or inaccuracies on the platform; personal injury or property damage arising from your use of the platform or a Booking Agreement with a host; unauthorised access to our servers or the information stored there; interruption of transmission to or from the Platform; or bugs, viruses, or similar transmitted by a third party through the Platform.
10.5 Responsibility for the parking space, its condition, availability, and the conduct of the host during the booking period rests with the host, not Park EZ — once a guest’s booking is confirmed, our obligations are as set out in this Agreement and we have no further obligation regarding the parking space itself. We make efforts to ensure hosts provide a good service but accept no liability if a parking space or a host’s service doesn’t meet a guest’s expectations; the right of action in that case lies against the host, though we may assist, at our discretion, in resolving the dispute.
10.6 You agree that we shall not be liable to you for any loss you suffer as a result of a government or public authority bringing proceedings against you, or taking any other action against you, as a result of listing a parking space on the platform.
10.7 Any claim against us in connection with this Agreement must be brought within 1 month of the booking to which the claim relates, except where a longer period is required by law. We will not be liable to you in connection with a claim by another host or guest against you, and are not required to return any money received under this Agreement to you, a host, or a guest in those circumstances.
11. Indemnity
11.1 To the extent permitted by law, you indemnify Park EZ, our officers, employees, and agents against claims, losses, damages, and reasonable costs (including legal costs) arising from: your breach of this Agreement, the Host Service Agreement, or a Booking Agreement; your unlawful conduct or negligence; content you upload causing damage to a third party; or your violation of another person’s rights (including intellectual property or privacy rights). This clause does not require you to indemnify us for loss caused by our own negligence or breach and does not apply to the extent it would render a term of this Agreement an unfair contract term under the Australian Consumer Law.
12. Governing law
12.1 This Agreement is governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.

A2. Host Service Agreement (applies to Hosts only, in addition to Part A1)
1. Appointment as exclusive agent
1.1 As a host, you appoint Park EZ as your exclusive agent to advertise your parking space, to form binding Booking Agreements between you and guests, and to collect booking payments on your behalf. For this purpose, a “guest” includes anyone who books your space, enquires about it (whether or not they complete a booking), or becomes aware of you, your address, or your parking space through your Park EZ listing.
1.2 If you arrange or accept a booking with such a guest outside the Platform within 12 months of the guest’s last booking (or of their introduction to you through Park EZ), you remain liable to us for the fees we would have received had the booking been made through the platform, plus our reasonable costs of enforcing this clause, which we may deduct from your payment details or Park EZ balance.
2. Host obligations
2.1 You warrant that you own or are authorised to use the parking space, and, where required, have obtained landlord, tenant, or body corporate/strata approval to license it out, and that the listing complies with all applicable laws, council permits, zoning rules, and body corporate by-laws.
2.2 You must provide accurate, complete listing information (address, vehicle restrictions, access instructions, your contact and identity details) and keep it up to date. You are liable to a guest for reasonably foreseeable loss caused by inaccurate, incomplete, or misleading listing information, which may include damages for misrepresentation or breach of contract.
2.3 You must ensure the parking space is available and in a satisfactory condition consistent with your listing before each Booking Period and must honour confirmed bookings.
2.4 You authorise Park EZ to send promotional material to guests about your listing and to refer to your listing (in de-identified or aggregate form where appropriate) in our own marketing.
2.5 You must respond to a booking enquiry within 48 hours, after which the offer may be revoked and we may suggest alternative spaces to the guest.
3. Guest not checking out / vehicle remaining in the Parking Space
Because charging continues under the Booking Agreement (clause 4) until a guest uploads a departure geotagged photo, the following applies if a guest’s vehicle remains in the parking space beyond the estimated duration without a departure photo being taken:
- Park EZ will attempt to contact the guest to confirm their status and encourage prompt check-out.
- If the guest cannot be reached and the vehicle remains after 24 hours beyond the estimated duration, Park EZ or the host may exercise such rights over the vehicle as are lawfully available to secure any unpaid charges.
- If the vehicle remains after 3 days, Park EZ or the Host may terminate the Booking Agreement immediately and require immediate removal of the vehicle from the Parking Space.
- If the vehicle remains after 7 days and the guest cannot be reached, Park EZ may, at its discretion and where lawfully permitted, treat the vehicle as abandoned and deal with it accordingly.
- Separately, if any additional amount charged under clause 4.5 of the Booking Agreement fails or is not received, Park EZ may pursue collection through standard means (including a debt collector or legal proceedings) and may suspend the guest’s account from making further bookings until the amount is paid.
4. Fees and commission
4.1 Park EZ adds a service fee/markup of 30% to the rate you set for your Parking Space (your “Host Rate”), shown per unit of time (e.g. per hour or per day). The combined amount is shown to guests as the total advertised rate (inclusive of GST where applicable).
4.2 Example: Host Rate = $10 per hour; Park EZ service fee = $3 per hour (30% markup); Total advertised rate = $13 per hour. If a Guest’s actual time in the Parking Space (measured between their arrival and departure geotagged photos) comes to 4 hours, the guest is charged $52 in total; the host receives $40 and Park EZ retains $12 commission. Park EZ may also deduct a Host admin fee of 3% (inclusive of GST) from the Host’s share. This Host Admin Fee is reduced to $0 during any period in which the Host qualifies for a $0 Host Admin Fee under a specific Park EZ offer or promotion (for example, the Founding Hosts’ offer in Part A5, clause 8, or the Host Referral Program in Part A5, clause 9) — in that case the Host keeps 100% of their share for bookings made during that period. Park EZ may change its fee structure on reasonable notice.
4.3 Park EZ also charges the guest a flat service fee of $0.99 for each booking, in addition to the booking fee in clause 4.1, regardless of whether the guest holds an active ParkEZ Plus membership. It is charged in full at the time of booking, is Park EZ’s own revenue only (it is not shared with the Host and does not affect the Host Rate), and is not refunded even if the booking is later cancelled or the Guest does not arrive.
4.4 If a guest’s deposit is forfeited under the Cancellation Policy (for example, a late cancellation or a no-show), the forfeited deposit is not retained by Park EZ alone. It is split between Park EZ and the host in the same proportion as a completed booking would be — the host receives the same share of the forfeited deposit that they would have received had the booking been completed for the estimated duration at the host rate (less the Host Admin Fee in clause 4.2, if any applies for that period), and Park EZ retains the remainder. This ensures a host is paid for having held the parking space and turned away other bookings, even where a guest cancels late or does not arrive.
4.5 The same principle applies where a guest completes a booking (arrives and departs) but their actual time in the parking space means the amount they owe is less than the deposit, so the deposit itself becomes the final amount charged (Part A3, clause 4.4). In that case, you are paid based on the guest’s estimated duration at booking, not their shorter actual duration, in the same proportion as clause 4.4 above. This reflects that you held the parking space for the guest’s original estimated duration regardless of how long they actually stayed.
4.6 We remit host payments (less our fees) within 10 business days of the end of a booking (once the guest’s departure geotagged photo has been taken and the final charge calculated). We may waive this timeframe at our discretion but are not obliged to pay you before receiving cleared funds from the Guest.
5. Bonds and access devices
5.1 If your listing involves an access device (e.g. key, swipe card, remote, fob), you may require a bond from the guest to cover its loss or non-return. Park EZ holds the bond for the duration of the booking. When the booking is completed or the device returned, you can log in to your dashboard and refund the bond to the Guest.
5.2 We will attempt to contact the guest and host for up to 7 days after booking completion to confirm the bond refund. If the bond cannot be refunded within 120 days of the booking ending, Park EZ will retain the bond.
6. Termination of Host status
6.1 Either party may terminate the host relationship at any time, but you must honour outstanding confirmed bookings. From the date of termination, we will not accept new bookings for your parking space, but this Agreement continues to apply to existing bookings and their consequences (fees, disclaimers, liability).
A3. Booking Agreement (between Host and Guest for a specific booking)
This sets out the terms on which a host permits a guest to use a parking space. Park EZ is not a party to this Booking Agreement, other than as the parties’ agent to help form it, administer payment, and (at its discretion) assist with dispute resolution. This Agreement, and any additional terms in the Host’s listing, form the whole agreement between host and guest; neither party may add further terms after a booking is made without Park EZ’s consent.
1. Formation
1.1 A Booking Agreement becomes binding once the host accepts a booking (including via auto-accept settings) and the deposit is received by Park EZ.
2. Guest rights and obligations
2.1 Subject to clause 2.2, the guest may permit another person (“Authorised Person”) to use the parking space, and is responsible for that person’s compliance with this Agreement and for their conduct.
2.2 The guest must use the parking space only at the booked times using the registered vehicle notified at booking (contact Park EZ in advance to change it — using a different vehicle may mean you’re unable to park). Using the space outside the booked times may make the guest liable to the host, and the vehicle may be towed or removed at the guest’s expense. The guest authorises Park EZ and/or the host to arrange for the vehicle to be towed, removed, or stored in these circumstances, and agrees that Park EZ may charge any towing, removal, or storage costs to the payment details provided at booking, in addition to any other amounts owing under this Agreement.
2.3 The guest must inspect the space at the start of the booking period and immediately raise any mismatch with the listing directly with the host; if the host can’t be reached or is uncooperative, contact Park EZ.
2.4 Disputes should, where possible, be resolved directly between host and guest at the start of the Booking Period so the booking can still be fulfilled; otherwise, Park EZ may mediate at its discretion.
2.5 The guest must vacate by the end of the booking period (as stated in the booking confirmation), and must not access any part of the host’s property beyond what is reasonably required to access the parking space. The guest has a grace period of 30 minutes after the end of the booking period to vacate the parking space without this being treated as a breach of this clause, provided the parking space is not required for another confirmed booking during that time.
2.6 The guest has primary responsibility for their own safety and their vehicle’s security during the booking period; the host is not responsible for the guest’s or an Authorised Person’s safety, or the safety of the vehicle, except to the extent caused by the host’s own negligence.
2.7 The guest keeps the space clean and free of rubbish and leaves it as found, does not obstruct adjoining spaces or property, notifies the Host or Park EZ of any damage as soon as it occurs, does not cause nuisance, does not conduct illegal or commercial activity from the space, uses it only for parking, acts courteously towards the Host, and holds a valid driving licence and vehicle registration at all times. The guest indemnifies the host for loss caused by the guest’s negligence, except to the extent caused by the Host’s own negligence.
3. Host rights and obligations
3.1 The host must provide the parking space as described in the listing, comply with all applicable laws, rules, and body corporate requirements, use best efforts to resolve disputes promptly so the booking can still be fulfilled, and confirm as soon as practicable whether a booking is accepted (including via auto-accept settings).
3.2 Each party warrants it has the power and necessary approvals to enter into this Agreement. The host additionally warrants that they own or are authorised to license the parking space (including any necessary landlord, tenant, or body corporate consent) and that the licence complies with all applicable laws.
4. Payment
4.1 At the time of booking, the guest provides an estimated duration for which the parking space will be needed, and pays a deposit of 50% of the estimated total price for that duration (the “Deposit”), calculated at the rate shown on the listing.
4.2 On arrival, the guest must take a geotagged photo through the website showing their arrival at the parking space; taking this photo commences the charge for the booking under clause 4.3. On departure, the guest must take a second geotagged photo showing their departure, in each case in accordance with our Privacy Policy.
4.3 Charging for the booking begins when the guest takes the arrival geotagged photo required by clause 4.2, and continues to accrue at the rate shown on the listing until the guest uploads a geotagged photo confirming their departure from the parking space. The amount payable is calculated on this basis, rather than on the Guest’s estimated duration given at booking.
4.4 The deposit is the minimum amount payable for any booking. If the amount payable under clause 4.3 is less than the deposit, the guest is not entitled to a refund of the difference.
4.5 If the amount payable under clause 4.3 is more than the deposit, Park EZ will charge the guest the additional amount owing, using the payment details provided at booking.
4.6 If the guest does not take an arrival geotagged photo, charging is deemed to begin at the scheduled start time of the booking period stated in the booking confirmation. Failure to take an arrival geotagged photo does not otherwise affect the guest’s obligation to pay in accordance with this clause, but may affect the guest’s ability to dispute the condition of the parking space at check-in under the Money-Back Guarantee Policy.
4.7 If the guest has not uploaded a departure photo within a reasonable period and cannot be reached, Park EZ or the host may bring the charge under clause 4.3 to an end using other reasonable evidence (for example, confirmation that the vehicle has left the parking space), rather than allowing it to accrue indefinitely — see also Part A2, clause 3, which covers a guest’s vehicle remaining in the Parking Space without a departure photo being taken.
4.8 Payment to Park EZ (whether as a deposit or otherwise) discharges the guest’s payment obligation to the host in full; Park EZ is authorised to accept payment on the host’s behalf and to process transactions using the guest’s saved payment details without separately checking authorisation for each charge.
4.9 Hosts must provide their Australian bank account details (BSB, account number, account name) to be paid. Guests must provide valid card details for all payments owed to Park EZ or a host.
4.10 Each party is responsible for their own taxes (including GST and income tax) and any applicable parking or congestion levies arising from a booking — see Part A1, clause 9.3 for guidance.
4.11 If a guest’s additional payment under clause 4.5 fails or isn’t received, Park EZ may pursue collection (including via a debt collector or legal proceedings) and recover reasonable additional costs of doing so, and Park EZ or the Host may deny the Guest access until the default is resolved — see Part A2, clause 3.
5. Cancellations and the Money-Back Guarantee
5.1 All bookings are subject to Park EZ’s Cancellation Policy and Money-Back Guarantee Policy, which the host and guest agree to comply with, and which Park EZ may administer by making refunds.
5.2 Cancellations must be made through Park EZ, not directly with the other party, to be effective — see the Cancellation Policy for how to cancel and what refund (if any) applies.
5.3 If a booked Parking Space is unavailable, materially misdescribed, or otherwise doesn’t meet what was promised, see the Money-Back Guarantee Policy rather than this clause.
6. Complaints and disputes
6.1 The host and guest must first attempt to resolve any dispute directly using the contact details Park EZ provides. If unresolved, either party may refer it to Park EZ, which may (at its discretion) investigate and mediate but is not obliged to resolve the dispute or guarantee any particular outcome.
7. Confidentiality
7.1 The host and guest must not disclose confidential information obtained about each other through the booking, other than information that is already publicly available.
A4. Mobile / SMS Terms of Service
By providing your mobile number and consenting to SMS from Park EZ, you agree to receive recurring text messages (including automated messages) relating to your account and bookings, and, if you opt in, promotional messages. Consent to SMS is not a condition of using the Platform or making any purchase, and participation is voluntary. Message and data rates may apply. Text STOP to opt out of promotional messages at any time; you will receive a one-time confirmation and no further messages unless you re-initiate contact. Carriers are not liable for delayed or undelivered messages, and we are not liable for failed, delayed, or misdirected messages to the extent permitted by law. A5. ParkEZ Plus Membership Terms (applies only to Users who subscribe)
1. What ParkEZ Plus is
1.1 ParkEZ Plus is an optional, recurring paid membership that provides the benefits set out on the Platform at the time of subscription, which may include a reduced booking fee, priority access to high-demand parking spaces, relaxed cancellation terms, priority visibility for Host listings, faster Host payouts, a member badge, and priority customer support, as described in clause 5 below.
1.2 Figures marketed as “average member savings” are illustrative estimates based on typical usage patterns, not a guarantee of savings for any individual member.
2. Plans and pricing
2.1 ParkEZ Plus is available on a Monthly Plan ($7.99 per month) or a Yearly Plan ($79.99 per year), or such other plans and pricing as Park EZ may offer on the platform from time to time.
2.2 Park EZ may change membership pricing on reasonable notice. A price change will not apply to a billing period you’ve already paid for — only to renewals after that.
3. Billing and auto-renewal
3.1 Your membership fee is charged to the payment method on file at the start of each billing period (monthly or yearly, as selected), and automatically renews at the end of each period unless you cancel before the renewal date under clause 4.
3.2 We will give you reasonable advance notice before your first renewal charge, and otherwise handle recurring billing consistently with our obligations under Australian law.
4. Cancelling your membership
4.1 You may cancel your ParkEZ Plus membership at any time through your account settings, or by emailing support@parkez.com.au. Cancelling your membership is separate from cancelling a parking booking — see the Cancellation Policy for that.
4.2 If you cancel, your membership and its benefits continue until the end of your current paid billing period. You will not be charged again after that, and we do not refund the unused portion of a current billing period, except as required by law.
5. Membership benefits
ParkEZ Plus is available to, and benefits both, guests and hosts. Some benefits apply only when you’re acting as a guest, some only when you’re acting as a host, and some apply either way.
Benefits for Guests
5.1 Reduced booking fee. Park EZ’s service fee/markup (Part A2, clause 4.1) is reduced from 30% to 20% for a guest’s bookings made with an active ParkEZ Plus membership. This reduced rate is still a charge, not a waiver — it is charged in full on every booking made while the membership is active, with no monthly cap, no credit to track, and no per-booking eligibility test.
5.2 Priority access to high-demand Parking Spaces. A guest with an active ParkEZ Plus membership may be given an earlier booking window than other Guests (for example, 24 hours’ advance access) for parking spaces that Park EZ or a host marks as high-demand or limited-availability listings (for example, event or stadium parking). Park EZ decides which listings this applies to, and may change or remove this benefit for particular listings at any time.
5.3 Relaxed cancellation terms. Clause 7 of the Cancellation Policy (which allows Park EZ to retain the Deposit for a late cancellation or no-show) does not apply to a booking made by a guest with an active ParkEZ Plus membership; instead, that guest’s deposit is refunded in full for any cancellation made before arriving at the Parking Space. This clause does not affect charges for time already used after arrival, which apply to all Guests in the same way under Part A3, clause 4.
Benefits for Hosts
5.4 Priority payouts. Park EZ will aim to remit payments to a host with an active ParkEZ Plus membership within 5 business days of a booking ending, instead of the 10 business days in Part A2, clause 4.6. This timeframe is a target, not a guarantee, and may be affected by matters outside our control (for example, delays by financial institutions).
Benefits for all members
5.5 Verified Plus badge. An active ParkEZ Plus membership may display a badge on a User’s profile or listings, whether they are acting as a guest or a host. This reflects active paid membership only — it is not a safety, quality, or identity verification beyond what is otherwise described in these Terms.
5.6 Priority support. A user with an active ParkEZ Plus membership may access a priority customer support channel, details of which are provided on the Platform.
6. Changes to or discontinuation of ParkEZ Plus
6.1 Park EZ may change, add, or remove ParkEZ Plus benefits, or discontinue ParkEZ Plus altogether, on reasonable notice. If we discontinue ParkEZ Plus, we will not charge further membership fees, and will not charge for any period after discontinuation.
7. Relationship to other terms
7.1 This Part A5 modifies the relevant clauses of Part A2 (Host Service Agreement), the Booking Agreement (Part A3), and the Cancellation Policy, only to the extent stated in clause 5 above. All other terms of this Agreement, the Cancellation Policy, and the Money-Back Guarantee Policy continue to apply to ParkEZ Plus members in the same way as any other User.
8. Founding Hosts’ offer
8.1 The first 100 Hosts to have an approved parking space listing published on the platform (each a “Founding Host”) receive, for the 12 months following the date their first parking space listing is approved (the “Founding Host Period”):
(a) an active ParkEZ Plus membership at no charge, instead of paying the standard Monthly Plan or Yearly Plan fee under Part A5, clause 2.1; and
(b) a $0 Host Admin Fee (Part A2, clause 4.2) on every booking of the Founding Host’s own Parking Space listing(s), so the Founding Host keeps 100% of their Host earnings on those bookings (before any deduction that applies to all Hosts regardless of Founding Host status, such as the forfeited-deposit split in Part A2, clause 4.4, which continues to apply in the same way, just without a Host Admin Fee component during this period).
This is the entire Founding Host offer. Benefit (b) applies only to the Host Admin Fee otherwise deducted from the Founding Host’s own earnings as a host on their own listing(s) — it does not change the booking fee (Part A2, clause 4.1) or flat service fee (Part A2, clause 4.3) charged to a guest who books the Founding Host’s Parking Space, and it creates no additional waiver on bookings the Founding Host makes as a guest at someone else’s Parking Space. A Founding Host’s guest-side bookings continue to be governed solely by their ParkEZ Plus membership under clause 8.2 below and Part A5, clause 5.1, in exactly the same way as any other Plus member.
8.2 During the Founding Host Period, all ParkEZ Plus benefits described in Part A5 apply to the Founding Host automatically and at no cost — including the reduced 20% booking fee on bookings the Founding Host makes as a guest (clause 5.1), priority access to high-demand spaces (clause 5.2), relaxed cancellation terms (clause 5.3), priority visibility and priority payouts as a host (clauses 5.4–5.5), and the badge and priority support benefits (clauses 5.6–5.7).
8.3 If a Founding Host would otherwise separately qualify for, or already holds, a paid ParkEZ Plus membership, benefit 8.1(a) simply covers the cost of that membership for the Founding Host Period. It does not create a second, stacked membership, and does not provide any benefit beyond what Part A5, clause 5 already gives a paying Plus member.
8.4 After the Founding Host Period ends, both benefits under clause 8.1 end: the complimentary ParkEZ Plus membership ceases (clause 8.1(a)), and the standard 3% Host Admin Fee under Part A2, clause 4.2 resumes on the Founding Host’s bookings (clause 8.1(b)) — the Founding Host reverts to standard (non-Plus) fees under Part A2, clause 4, in the same way as any other user, unless they choose to continue as a paying ParkEZ Plus member under Part A5, clause 2.
8.5 This offer is personal to the Founding Host’s account and parking space listing that first qualified for it. It is not transferable to another user, another account, or another parking space, and is not redeemable for cash, credit, or any other benefit.
8.6 This offer is available only to the first 100 Hosts who qualify under clause 8.1, on a first-come, first-served basis, and Park EZ may withdraw or amend this offer at any time before a host qualifies.
9. Host Referral Program
9.1 Park EZ may operate a referral program under which an existing host (the “Referrer”) refers a prospective new host (the “Referred Host”) to the Platform using a personal referral link or code.
9.2 If a Referred Host (a) creates an account using the Referrer’s referral link or code, (b) publishes an approved Parking Space listing, and (c) completes at least one booking of that Parking Space, then both the Referrer and the Referred Host each receive 1 month of $0 Host Admin Fee (Part A2, clause 4.2) on their own Parking Space bookings (a “Referral Reward”).
9.3 A Referral Reward is credited once the conditions in clause 9.2 are met, and applies from the date it is credited — it does not apply retrospectively to bookings completed before that date.
9.4 There is no limit on the number of times a Host may act as a Referrer and earn a Referral Reward, provided each Referred Host is a genuine new User who was not already registered with Park EZ.
9.5 A Host must not refer themselves, create or use a duplicate or fraudulent account, or otherwise attempt to manipulate this program. Park EZ may withhold, reverse, or reclaim a Referral Reward, and may suspend a Host’s participation in this program or their account, if it reasonably suspects abuse of this clause 9.
9.6 A Referral Reward is a fee waiver only. It is not paid as cash, is not transferable, and does not affect a Host’s obligation to account for it as assessable income where applicable — see Part A1, clause 9.3.
9.7 A Referral Reward does not stack with any other Host Admin Fee waiver that may apply to the same period. If a Host already has the Host Admin Fee waived under another Park EZ offer or promotion — for example, a Founding Host’s $0 Host Admin Fee under clause 8.1(b) — when a Referral Reward is credited, the Referral Reward instead extends the total period during which the Host Admin Fee is waived, rather than running concurrently and going unused.
9.8 Park EZ may change or discontinue this Host Referral Program, or the value of a Referral Reward, on reasonable notice. A change does not remove a Referral Reward already credited under clause 9.2.
